1. Introduction

Welcome to Incite360! These Terms of Service (“Terms”) govern your access to and use of our web application (“Platform”), including any content, functionality, and services offered. By accessing or using Incite360, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

2. Eligibility

To use Incite360, you must be at least 18 years old or the age of majority in your jurisdiction. By using the Platform, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into these Terms.

3. User Accounts

You are required to register an account to access certain features of the Platform. You agree to provide accurate and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Acceptable Use

You agree to use the Platform only for lawful purposes. You may not:

• Use the Platform for any illegal or unauthorized purpose.
• Access or attempt to access other users’ accounts.
• Distribute viruses, spam, or other malicious software.
• Reverse engineer, decompile, or disassemble any aspect of the Platform.

5. Survey Content Data

You retain ownership of the content you submit through the Platform. You grant Incite360 a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display such content for the purpose of operating the Platform.
You are solely responsible for the surveys you create and the data you collect. You agree not to collect sensitive personal data unless you comply with applicable data protection laws.

6. Google Review Integration

If you choose to integrate your Google Reviews with the Platform, you agree to abide by Google’s API Services User Data Policy. You must use a verified Google Business account and not a personal Gmail account for integration.
Incite360 will access and display your Google Reviews only to enhance your survey analytics and feedback collection. We do not store your Google account credentials.

7. Subscription & Billing

Some features require a paid subscription. You agree to pay all applicable fees and taxes. Subscription terms, including renewal and cancellation policies, will be provided at the time of purchase. Free trials will not be billed until the trial period ends, unless you cancel beforehand.

8. Termination

We may suspend or terminate your access to the Platform at our discretion, including for violations of these Terms. Upon termination, your right to use the Platform will cease immediately.

9. Privacy

Our collection and use of your information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

The Platform is provided “as is” and “as available.” We do not guarantee that the Platform will be uninterrupted or error-free. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Incite360 and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Platform.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes via email or through the Platform. Continued use after such updates constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed by the laws of the jurisdiction in which Incite360 operates, without regard to conflict of law principles.
